Welcome to Storibard.com. Storibard.com is a marketplace platform for services performed by its users.

The following terms and conditions (these “Terms of Service”), govern your access to and use of the Storibard website, including any content, functionality and services offered on or through www.Storibard.com (the “Site”).

 

GENERAL CONDITIONS

Storibard Online Freelance Services Ltd. (“www.storibard.com”) owns and operate this Website (Site).  Please read the Terms of Service carefully before using the Site. By using the Site, opening an account or by clicking to accept or agree to the Terms of Service when this option is made available to you, you accept and agree to be bound and abide by these Terms of Service and our Privacy Policy, listed below. If you do not agree to these Terms of Service or the Privacy Policy, you are not permitted to uses the services available through the Site. The services available through the Site is offered to those who are 18 years of age or older. Individual who are younger than 18 are not permitted to access services made available through the site. By using this Site, you represent and warrant that you are of legal age to form a binding contract and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Site.

You should check this page regularly to take notice of any changes we may have made to the Terms of Service. Access to this Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason this Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of this Website. This Website may contain links to other websites (the “Linked Sites”), which are not operated by www.storibard.com. www.storibard.com has no control over the Linked Sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them. Your use of the Linked Sites will be subject to the terms of use and service contained within each such site.

The materials appearing on www.storibard.com’s web site could include technical, typographical, or photographic errors. www.storibard.com does not warrant that any of the materials on its web site are accurate, complete, or current. www.storibard.com may make changes to the materials contained on its web site at any time without notice. www.storibard.com does not, however, make any commitment to update the materials.

 DEFINITIONS

Available Funds – Funds available to purchase Pearls on the storibard website

Earned value – the money earned by Bard (seller)s when an order is completed and delivered to the buyers

Bard Page – page that the Bard (seller) can describe their service offering, and the buyer can purchase the Pearls sold by the buyer

Bard (seller) –  users who offer and perform services through Pearls on Storibard.

Buyers  – users who purchase services on Storibard.

Buy Button – this button allows buyers to order a Pearl.

Clearance Period – amount of time that must elapse be funds can be withdrawn from account. This currently 14 days.

Disputes – disagreements experienced during an order between a buyer and Bard (seller) on Storibard.

Orders – the formal commitment established between buyer and Bard (seller) after a purchase was made from the Bard (seller’s) Bard Page.

Order Page – where buyers and Bard (seller)s communicate with each other in connection with an ordered Pearl.

Mark as Delivered Button – This button is used to deliver order to buyers.

Minimum Withdrawal amount – this minimum earned value that must exist before funds can be withdrawn from the account

Pearls  –  services offered on Storibard.

Pending Clearance – Funds that can be withdrawn after the clearance period.

Withdrawals – funds that has been withdrawn from the sales of Peals (Jobs)

 

ORDER AND PAYMENT SYSTEM OVERVIEW

  1. Only registered users may buy and sell on Storibard. Registration is free.
  2. Pearls on Storibard may be offered at a base starting price of $3. Some Pearls are offered at a base price of more than $3 as determined by the Bard (seller).
  3. Buyers pay Storibard in advance to create an order.
  4. Orders are purchased through the Order button found on a Bard (seller’s) Bard page
  5. For fees and payments please read the purchasing section.
  6. Bard (sellers) must fulfill their orders, and may not cancel orders on a regular basis or without cause. Cancelling orders will affect Bard (seller’s) reputation and status.
  7. Users may not offer or accept payments my any means other than orders made using the Storibard.ca system.
  8. Buyers are granted all rights for the delivered work, unless otherwise specified by the Bard (seller) on their Bard page.
  9. Storibard retains the right to use all published delivered works for Storibard marketing and promotion purposes.

 

Bards (Sellers)

  1. Bard (seller) create Pearls on Storibard that can be sold to buyers on Storibard.
  2. Each order that Bards successfully complete a delivers results in net revenue of 85% in their account
  3. Storibard credits the Bard (seller) account once an order is completed. See the orders section below for details
  4. If an order is cancelled (for any reason), the funds paid will be refunded to the buyer’s account value.
  5. Revenues are only made available for withdrawal from the Revenue page following a safety clearance period of 14 days after the order is marked as complete.
  6. Bard (seller) may not promote their Pearls or any Storibard content via the AdWords platform.
  7. Bard (seller) may make revenue withdrawals using Payment options or gateways.
  8. The Bard (seller)’s rating is calculated based on the order reviews posted by buyers.
  9. Storibard reserves the right to temporarily disable a Bard (seller’s) ability to withdraw revenue to prevent fraudulent or illicit activity.

 

Pearls

  1. Pearls created by Bard (sellers) on Storibard are governed by the guidelines of User Generated Content that is detailed below.
  2. Violations of the Terms of Service, may result in removal of Pearls. These may include (but are not limited to) the following violations and/or materials:
    • Illegal/fraudulent services
    • Infringement of copyright/Trademark Infringement and violation of a third party’s terms of service reported through the Intellectual Property Claims Policy found below
    • Inappropriate/Obscene
    • Intentional copies/facsimile  of  other Pearls
    • Spam, Nonsense, or Violent Pearls
    • Pearls that attempt to mislead buyers
    • Reselling of regulated goods
    • Services that extend beyond 30 days of service duration
  3. Pearls that are removed for violations mentioned above, may result in the suspension of the Bard (seller’s) account.
  4. Pearls  will not be restored if removed  for violations
  5. Pearls may include pre-approved website URLs contained within the description and requirements box. Any promotion of website content that violates terms of service will not be tolerated.
  6. Any images used to promote or advertise a Pearl must not violate any copyright or trademarks.
  7. Statements on the Pearl Page that undermine or circumvent these Terms of Service is prohibited.
  8. Eligible Pearls and Bard (sellers) may price their Pearls at a base price beyond $3.

 

Rating System

Storibard seeks to help Bards leverage their skills. We seek to ensure Bards are able to express and get paid for the creativity. Bards that receive positive ratings from buyers will be promoted.

 

Withdrawing Revenues

  1. To withdraw your revenue, you must have an account with at least one of Storibard’s withdrawal methods
  2. Revenues are only made available for withdrawal from the Revenue page following a safety clearance period of 14 days after the order is marked as complete.
  3. Withdrawal fees may be applied to withdrawls.
  4. Withdrawal process is irreversible once started.

 

 Withdrawal Methods:

  1. Withdrawals can be made to your Storibard account and be used as a credit for future purchases.
  2. Withdrawals can be made to your PayPal account may be subject withdrawal fees that could total up 2% or order price.

 

Purchasing Process

Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

General Conditions

  1. Buyers pay Storibard to create an order from a Bard (seller’s) Pearls page or Custom Offer, using the Buy Button.
  2. Pearls may be purchased using one of the following payment methods: Payment options or gateways
  3. Fees are added to amounts that buyers pay for their orders. Fees may be up to 2% of order cost to account for admin charge.
  4. Buyers may not offer to pay sellers by payment options or gateways not offered through www.storibard.com or its linked sites.
  5. To protect against fraud, unauthorized transactions (such as money laundering), claims or other liabilities, Storibard does not collect credit information; but allow our payment vendors to collect information for the purpose of collecting payments from buyers on the Site or transferring payments to Bard (sellers) on the Site. Storibard is not privy to credit information collected through the payment options or gateways.

 

Ordering Pearls

  1. A unique order number is assigned once payment is completed.
  2. Bard (seller) must deliver completed files and/or proof of work using the Mark As Delivered button
  3. Mark As Delivered button is used when the order is complete as defined by terms of use for the site. Incorrect use of the button can affect Bard (seller) ratings and could result in termination of the Bard (seller) account.
  4. An order is marked as complete after the order is approved by buyer (via Mark Complete button). It is then rated by the buyer.  After 4 days, order will be considered complete if not rated by buyer or a modification is not requested.
  5. We encourage our buyers and Bard (sellers) to try and settle conflicts amongst themselves however if this fails users can contact Storibard’s administrator.

 

The order fulfillment process:

  1. When buyers make an order, the Bard (seller) is notified by email as well as notifications on the site while logged into the account.
  2. Bard (seller) are required to meet committed delivery timeframe. Failure to do so can affect the Bard (seller) status.
  3. Bard (seller) must send completed files and/or proof of work using the Mark As Delivered button to complete the order.
  4. A Bard (seller) may cancel an order without the buyer’s consent at any given moment but this is strongly discourage as it will impact Bard (sellers) rating.
  5. Buyers may use the “Request Modifications” option if the delivered work does not meet required established to generate the order or does not match the content advertised by the Bard (seller). This option can be exercised when a Bard (seller) issues a completed order to the buyer.
  6. Users are responsible for scanning all transferred files for viruses and malware. Storibard will not be held responsible for any damages which might occur due to usage of the site or content delivered through the site.

 Reviews

  1. Review and feedback from buyers is key part of Storibard’s service model. Rating are an important way to ensure quality of service and testify to a Bard (seller) opinion of the service they received.
  2. We will not remove a buyers feedback unless it is inappropriate or violates or term and conditions.
  3. To ensure a fair, accurate and responsive feedback system, only feedback on actual work performed will be tolerated on the site. Fraudulent or inconsistent review will be removed and disciplinary action will be taken (included warnings or termination of Bard (seller) access).
  4. Review/Feedback will be public displayed on the Bard’s page. Buyer’s ratings (an optional comments) will be displayed on the Bard’s page.
  5. Withholding the delivery of Pearls to induce favorable reviews is not permitted
  6. Once work is issued, the buyer will be given three (4) days to respond and post a review.  Response not provided within the designated time will considered complete.
  7. Users are allowed to leave reviews on orders
  8. Bard (seller) may not solicit the removal of feedback reviews from their buyers through mutual cancellations.

 

DISPUTE RESOLUTIONS AND  CANCELLATION  PROCESS

We encourage our buyers and Bards to resolve disputes amicably however if necessary, the site administrator can contacted to assist with dispute resolution.

  1. Cancelling an order can be achieved by choosing the request mutual cancellation button or making a request to the administrator.
  2. Stopping or reversing payment through the payment provider is not permitted and could result in suspension of site access as it violates the Terms of Service.
  3. Storibard reserves the ability/responsibility to suspend orders that are suspected to be fraudulent.
  4. Transfer and assignment of intellectual property ownership to the buyer will be performed subject to full payment for the Pearl to Bard that originates it.
  1. If an order is cancelled (for any reason), the funds paid will be refunded to the buyer’s shopping balance.
  2. Cancellation of an order will result in refund being directed to buyers available funds.
  3. Bard (seller) have the ability to set the number of revisions offered to the buyers to ensure the buyers expectations are met.
  4. Requests for revisions can be competed on the order page after the Pearl has been issued. Revisions are to be confirmed to the established agreement between buyer and Bard (seller) at time of purchase of the Pearl.

Order Cancelation Process

  1. Storibard encourages Buyers and Bard (seller) to strive to resolve service disputes collaboratively or engage the site administrator.
  2. The validity to cancel an order will be evaluated to determine if terms of service have been violated, improper use or misconduct has been identified. Specific details are given below.
  3. Orders may be cancelled before order completion.
  4. Orders cannot be cancelled if Pearl that is delivered falls within requirements established at time of order generation.
  5. Illegitimate or non-permitted use of the site that includes harassment, violent, disparaging on illegal behavior can result in cancelation of orders.
  6. The Storibard Site administrator will cancel orders for the following reasons (not limited to):

    Active orders (after the buyer submits their requirements and before the Bard (seller) delivers on Storibard)

  1. The Bard (seller) is late and unresponsive for more than 24 hours after due date.
  2. Threats or abusive is used to ensure completion of work.
  3. Users supplied or included copyright/trademark infringing materials as part of order placement or delivery process.
  4. The user is no longer an active Storibard member due to violations of Terms of Service violations or account discontinuance.

Delivered Orders [after the Bard (seller) clicks Mark as complete] and before the order is marked as complete)

  1. The Bard (seller) extend the delivery due date to complete the requested service without providing the final delivered service to buyers.
  2. Note: Multiple reported offenses will result in permanent suspension of your account.
  3. The Bard (seller) does not supply the files and/or proof of work as defined in the order details.
  4. The Bard (seller) withholds delivery completed work in an attempt to gain additional payments or favorable reviews on and off the Storibard platform.
  5. Buyers who request numerous revisions or threaten Bard with abuse in attempt to gain services from Bards (sellers) that exceed previous requirements.

 

Completed Orders (after the order is marked as complete and before the 10 day limitation)

  1. Validated proof of use of confidential, copyright or trademark material used by User in the process of completion of orders.
  2. Failure of a buyer to purchase commercial use rights but are found to use the delivered work commercially.

 

Refunds

  1. Refunds (absent processing fees) for cancelled orders will be placed into the user’s Storibard account as credit available for future purchases.
  2. Refund of deposits will be performed by Storibard Site admin, subject to availability form the payment provider/gateway.  Refunds of processing fees for new orders placed using deposit funds will not be provided.

 

USER CONDUCT AND PROTECTION

Storibard exists to allow people to promote benefits of expressing and experiencing the benefits and manifestations of love and goodwill. As such, users are encourage to maintain a professional and respectful ways to interact and collaborate. The acceptable behaviours are outlined below. Violations of these behaviours should be reported to the Storibard site Admin.

General Conditions:

The following conditions must be observed:

  1. All user identities are kept confidential to ensure anonymity. As such email, IM contacts, telephone numbers and other personal contact details are not permitted to be exchanged in the course or on account of using services on Storibard.
  2. Storibard does not guarantee the quality of service offered by Bards. Storibard takes reports of a Bard’s work performance seriously and welcomes reviews from users.
  3. Storibard will not be held responsible or offer any protection for users who choose to conduct interactions outside the Storibard platform.
  4. All file exchanges or information transfers are to be performed on the Storibard platform.
  5. Discrimination of user based on race, gender, religious association, sexual orientation or any other personal qualities will not be tolerated.
  6. Rude or abusive language or actions is strictly forbidden.
  7. Defamation of sellers will be reviewed by the Site Admin and may result in termination of user access.
  8. Spamming or unwarranted solicitation of Bards by buyers may result in termination of site access.
  9. The site admin will arbitrate disputes between Bards and buyers. If necessary, Storibard may return funds (all or in part) to Bards where warranted.
  10. Storibard will evaluate complaints of copyright infringement or plagiarism of work from other users of the site. Disciplinary action will be taken where necessary.
  11. Storibard site administrators strongly encourages users to report violations of site etiquette, Terms and Conditions and profession conduct. The results of investigations may be kept confidential for privacy reasons.
  12. Storibard and all linked sites does not make any warranty regarding user conduct on the site. Users that violate the terms and conditions of the site will be disciplined or have access withdrawal upon validation of misconduct.
  13. Storibard does not screen users of the site. By agreeing to the terms and condition, users access the services offered through the site (or linked sites) and its partners, at their own risk.

Violations of terms of conditions may results in a warning to users via and email. The warnings may result in a limit of access to the site that is temporary or permanent.

Prohibitions

You must not misuse this Website. You will not: commit or encourage a criminal offense; transmit or distribute a virus, trojan, worm, logic bomb or any other material which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene; hack into any aspect of the Service; corrupt data; cause annoyance to other users; infringe upon the rights of any other person’s proprietary rights; send any unsolicited advertising or promotional material, commonly referred to as “spam”; or attempt to affect the performance or functionality of any computer facilities of or accessed through this Website. Breaching this provision would constitute a criminal offense and www.storibard.com will report any such breach to the relevant law enforcement authorities and disclose your identity to them.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this Website or to your downloading of any material posted on it, or on any website linked to it.

Users must observe the following restrictions:

  1. Phishing and Spam – Privacy of Storibard user is strictly enforces and any attempts to transmit, publish or send content that aims to compromise another member’s account or computer systems is forbidden. Members are not to be contacted for commercial purposes without their express consent.
  2. Privacy – Users are not to publish, post or distribute other members (of the Storibard) private information. Exchange of personal information for the service must be provided on the order page. Information provided to Bards, which is confidential or non-public domain, shall not be used for purposes other than to complete the work that is requested.
  3. Intellectual Property Claims – Storibard will investigate claims or allegations copyright or trademark infringement, and/or violation of third party’s terms of service. Where required, disciplinary action will be taken.
  4. Fraud / Illegal Use – Users are not permitted to use Storibard for any illegal, malicious or fraudulent activities.
  5. Behavior/Language – Users of Storibard are expected to main profession, courteous, and friendly communication decorum while using the Storibard platform. Hate speech, intolerance and coercion will not be tolerated.

ABUSE  AND SPAM

The following abuses will not be tolerated:

  1. Users are permitted to setup and maintain a single account on the Storibard website. Users who setup accounts that contravene the Terms and Conditions of the site will be subject to disciplinary action including termination of access privileges.
  2. Targeted Abuse – Harassment (verbal, physical or electronic) of member is strictly forbidden.
  3. Selling Accounts – Accounts obtained from the website are non-transferable. They cannot be bought or sold.

General Terms

The following conditions apply when accessing the Storibard site:

  1. Storibard may exercise the right to temporarily or permanently disable accounts as a result of breach or violation of the terms of service for this website.
  2. User who own disable account will not be allowed to conduct transactions on the website.
  3. Contacting the site admin to inquire about disabled account is an option available to users of the site.
  4. If required, sellers can renew accounts by providing required proof to the site admin.
  5. Storibard reserves the right to make changes to the Terms and Conditions at any time. Users acknowledge that using Storibard after Terms and Conditions have been updated, will be deemed to be acceptance of the updated Terms and conditions.
  6. In the event that a user still has funds in disabled account, Storibard will allow the withdrawal of the funds after 120 days of account suspension and after proof of ownership of the said account has been verified.

 

AUTOMATIC TRANSLATION

Storibard may contain text and language translations. Storibard makes no guarantee or warranty on the accuracy, correctness, reliability or fitness for purpose of the translated text. Furthermore,  Storibard makes no warranty or guarantees, express or implied, about the originality, noninfrigement or non-protected status of the content on the website.

 

DISCLAIMER OF LIABILITY

The material displayed or provide through the Storibard website is provided without any guarantees, conditions or warranties as to its accuracy. Unless expressly stated to the contrary to the fullest extent permitted by law www.storibard.com employees, agents, officers or directors and its suppliers, content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this Website or the Linked Sites and any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise. Neither Storibard nor any person associated with the Site makes or implies any warranty or guarantee with respect to completeness, security, reliability, quality, accuracy or availability of the site. This does not affect www.storibard.com’s liability for death or personal injury arising from its negligence, fraudulent misrepresentation, misrepresentation as to a fundamental matter or any other liability which cannot be excluded or limited under applicable law.

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.

In no event shall www.storibard.com or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on www.storibard.com’s Internet site, even if www.storibard.com or a www.storibard.com authorized representative has been notified orally or in writing of the possibility of such damage.

We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

 

INTELLECTUAL PROPERTY CLAIMS

REPORTING CLAIMS OF COPYRIGHT INFRINGEMENT (DMCA)

Storibard content is generally User Generated Content (UGC). While Storibard does actively review upload/created content for copyright or trademark infringement. However, we welcome feedback or notices about content that may violate any copyright or proprietary information. To provide notice to Storibard, follow this process. Storibard will investigate violation and remove content and terminate user access where warranted.

 

When providing notice on copyright or protected information, per DMCA requirements, please provide the following:

  1. Identification of copyrighted work and the nature of what is being protected by the copyright(s)
  2. The copyright certificate(s)/designation(s). List if the content is registered or unregistered
  3. Proof of copyrights ownership, including the registration number. Alternatively, provide a copy of the registration certificate
  4. Explain how a user of Storibard infringed (allegedly) infringe on your copyright.
  5. Provide a link to the alleged infringing material and the content delivered by the Storibard user.
  6. Your contact information including complete name, address, email address, and telephone number.
  7. Provide statement, witnessed, that attest that you do not believe the use of the material/information content that is the subject of the complaint was not authorized by the originator of the content.
  8. Provide statement that you information you submit is accurate to you knowledge. Furthermore, confirm that you own the copyright/protected material or have authority to represent the author of the material.
  9. Your electronic or physical signature

 

User Generated Content

User Generated Content (“UGC”) refers to the content added by users as opposed to content created by the Site. All content uploaded to Storibard by our users (Buyers and Bard/Seller) is User Generated Content. Storibard does not check user uploaded/created content for appropriateness, violations of copyright, trademarks, other rights or violations. We invite everyone to report violations together with proof of ownership as appropriate. Reported content, if found to be in violation of copy right laws, will be removed or disabled.

Storibard does not accept responsibility for the quality, method of delivery, service delivery, content or produced by Bards/Sellers in effort to satisfy orders from buyers. The Site does to provide warranty or guarantees in regards to nature of the pearls, the method of delivery and manner of communication between buyers and Bards (sellers). By accepting our Terms of Service and offering services through the Site, Bards profess they have the need permissions, rights, licence or certifications to sell or resell the services offered by Storibard. Failing to comply with governing copyright law or Terms of Service of the Site may result in removal of the service/Pearl and/or termination of user account.

Our policy regarding intellectual property claims are constitute a key part of our Terms of Service and are contained herein. It’s our policy to terminate accounts or users who violate copyright laws on a repeat basis.

OWNERSHIP OF INTELLECTUAL PROPERTY

Buyers who purchase products through Storibard will be granted all intellectual property rights (including copyright and moral rights) when the work has been delivered to and fully paid for through the site. Once the Bard/Seller has been fully paid for the service or product they provide to the buyer, the Bard/Seller waives their claim to the intellectual or moral rights associated with the product or service.

Work performed by the Bard is classed as work-for-hire as defined by the United States Copyright Act. If the delivered work does not meet the requirements of the copy right act or if the act does not apply, the Bard consents to transfer property rights (intellectual or moral) upon receipt of full payment. The Bard/Seller also consents to assign all rights, titles and interests to the Buyer in the case of custom work.

Bards may charge additional payments for a Commercial Use License.  If a product or service is purchased solely for personal use, retain ownership of the all rights but do not require a commercial use license. However, if you intended to use product/service to commercial purposes or to earn revenue, or directly or indirectly in association with a business – you will need to purchase a commercial use license.

In compliance with Storibard’s privacy policy, Bard (sellers) further acknowledge that the information they receive from the buyer will be kept confidential if it does not exist in the public domain. Furthermore, the information and shall not be shared or used for any reason other than to complete an order placed by the Buyer/Seller.  Additionally, users (both buyers and Bard/sellers) acknowledge that Storibard may use content, for promotional or marketing purposed, that is uploaded (picture, videos, text based content including user names) with remuneration or consideration at any time. This also applies to delivered work.

 

COMMERCIAL USE LICENSE

Buyer are to indicate to Bards/sellers if the intended to use the Pearl for commercial use or in connection with a business for purpose of generating profits. When the Buyer purchases a “Commercial Use License” the Bard (seller) confers  perpetual, exclusive, non-transferable, worldwide license to use the purchased delivery for Permitted Commercial Purposes.

“Permitted Commercial Purposes” means any business related use that include (but not limited to) advertising, promotion, creating web pages, integration into product/ software or other business related tools. Use for immoral or defamatory reasons are prohibited.

This License is subject to Storibard’s Terms of Service. The work provided by the Bard/Seller, through the Storibard website, is provided without any guarantees, conditions or warranties as to its accuracy. Unless expressly stated to the contrary to the fullest extent permitted by law www.storibard.com employees, agents, officers or directors and its suppliers, content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this Website or the Linked Sites and any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise.
